Private: McCune Law Group Files Claims Alleging Adelanto Elementary School District Failed to Protect Three Employees Under Restraining Order

ADELANTO, Calif., Aug. 4, 2026 — Ireri Peralta, Xenia Lovett, and Sandra Alamillo, three longtime Adelanto Elementary School District Executive Assistants, have each filed a government tort claim alleging retaliation, harassment, and failure to protect them following a court-issued restraining order against District Board Member Michael Krause.

“Hey, guys. Joe Richardson from McCune Law Group. Wanted to say that we have filed a claim on behalf of Ireri Peralta, Xenia Lovett, and Sandra Alamillo against Adelanto Elementary School District. We allege, among other things, 1102.5 whistleblower retaliation and harassment at the hands of the District, including, among others, District Board Member Michael Krause.

We allege that historically, issues with Mr. Krause were so bad that it resulted in our clients’ successful attempts to get a restraining order against him. We allege that other people at the District knew about the issues, and we further allege that since the restraining order was obtained, and knowing that there would be attempts to retaliate based on those, the District has not done enough to protect our clients.

According to our claims, the school district’s failure to adequately protect our clients has resulted in adverse actions that materially affect the terms, conditions, and privileges of their employment.

At the end of the day, in this case, we allege that our clients’ success in getting the restraining orders made them targets. The District ultimately protected Krause from the women he was ordered to stay away from, and not the other way around. Those are our allegations.”


What the Claims Allege

The three government tort claims, submitted July 30, 2026 under Government Code Sections 810–996.6, allege the District failed to protect Ireri Peralta, Xenia Lovett, and Sandra Alamillo after they obtained a restraining order against Board Member Michael Krause.

According to the claims, the harassment began roughly five years before the women reported it to the District’s Human Resources department in April 2024. On March 19, 2025, San Bernardino Superior Court issued a workplace violence restraining order against Krause on behalf of all three women. Krause was elected to the Board that fall.

The claims allege the District has failed to consistently enforce the order’s distance and security provisions since Krause’s election. At a July 2025 conference, Ms. Alamillo alleges Krause sat behind her at lunch, and that police questioned her, not him, once she reported the violation. Two of the claims allege Krause posted a campaign sign near each woman’s home during his 2024 Board run, in neighborhoods outside the area he sought to represent.

Each claim asserts violations of Title IX, the Fair Employment and Housing Act (FEHA), Labor Code Section 1102.5, and negligence under the Government Claims Act, seeking damages in excess of $35,000.

A Pattern of Retaliation the Claims Say the District Ignored

The claims allege each woman faced retaliation after reporting Krause’s conduct and pursuing the restraining order, including exclusion from Board meetings, inconsistent security accompaniment, and reductions to job duties or compensation.

The claims further allege that Krause told the District’s Interim Superintendent he was “not done” with the three women, and that the District canceled its outside counsel’s contract after Board members said the firm had “gone after” Krause, while arranging separate counsel for him in the same matter.

Despite the order, the District spent its resources protecting him from them, not the other way around. According to these claims, the District let them down at every turn after they came forward.”

The allegations have not been adjudicated, and the District has not responded.
